Terms of Service
The terms that apply to your use of this website and when you instruct us to secure your property
1. Who We Are and How These Terms Apply
These Terms of Service ("Terms") govern your use of the website at beyondproperty.co.uk (the "Website") and the supply of site security services (the "Services") by Beyond HNGT Ltd, a company registered in England and Wales under company number 12787432, trading as Beyond Property ("we", "us", "our", the "Company"). Our registered office is at 62 Thames Street, Sunbury-on-Thames, TW16 6AF. We can be contacted at [email protected] or on 020 3355 0068.
The website use, acceptable use, and intellectual property provisions in clauses 5 and 6 apply to anyone who uses the Website. The remainder of these Terms applies to any person or organisation that instructs us to provide Services ("Client", "you", "your"). They apply from the point you accept a quotation, sign a service agreement, or otherwise ask us to begin work, whichever happens first, and they form part of the contract between us (the "Contract"). Where we agree a separate written services agreement, schedule of services, or order form with you, that document takes precedence over these Terms to the extent of any conflict, but these Terms otherwise continue to apply.
These Terms take priority over any terms and conditions you attempt to impose or incorporate, including terms on a purchase order, unless we have expressly agreed to those terms in writing signed by a director of the Company.
Where these Terms refer to a "Consumer", this means an individual Client acting for purposes that are wholly or mainly outside that individual's trade, business, craft or profession, as defined in the Consumer Rights Act 2015. Most of our Clients — landlords, investors, developers, managing agents, local authorities, and other businesses — are not Consumers. Nothing in these Terms is intended to remove or reduce the statutory rights of a Client who is a Consumer.
2. Definitions
- "Website" means beyondproperty.co.uk, including any subdomain, page, or tool made available on it.
- "Site" means the property or properties at which we agree to provide the Services.
- "Equipment" means any CCTV camera, alarm sensor, control panel, access control hardware, signage, or other apparatus we install, place, or leave at the Site in connection with the Services.
- "Personnel" means any individual, whether employed directly by us or engaged through a subcontractor, deployed to perform the Services, including security officers, keyholders, drone pilots, and engineers.
- "Guardian" means an individual placed to occupy a Site under our property guardian programme, and "Guardian Licence" means the licence to occupy agreement between that individual and us, as described in clause 11.
- "Fees" means the charges payable by the Client for the Services as set out in our quotation, order confirmation, or invoice.
3. Our Services
We provide a range of property security services which, depending on what you instruct us to do, may include: CCTV systems and remote monitoring; intruder alarm systems and monitoring; access control systems; security personnel, including static guarding, mobile patrols, key holding, and event security; property guardian placement and management; and drone surveys and inspection reports.
The specific scope of the Services we provide to you will be set out in our quotation, proposal, or service agreement. Where our marketing materials, website, or service pages describe typical response times, installation timescales, or features of a service (for example, that CCTV is "typically" installed within 24 to 48 hours), those descriptions are indicative only. They describe what we usually achieve, not a contractual commitment, unless a specific timescale is expressly agreed in writing as part of your Contract.
We reserve the right to make changes to the Services that are necessary to comply with applicable law or regulatory requirements, or that do not materially affect the nature or quality of the Services, and we will notify you of any such change.
4. Quotes, Enquiries and Forming a Contract
Enquiries submitted through the Website, by phone, or by email are not an offer capable of acceptance and do not, by themselves, create a Contract between us. Following an enquiry, we will typically arrange a consultation and, where appropriate, a site survey to assess the Site before providing a quotation.
A Contract is formed when you accept our quotation, order confirmation, or service agreement, as described in clause 1 (including by signature, email confirmation, or by asking us to proceed). Quotations are valid for the period stated on the quotation or, if none is stated, for 30 days from the date of issue.
In urgent circumstances, particularly rapid or emergency deployments, Services may be agreed verbally or by email before a written quotation is issued. These Terms still apply to any such engagement, and we will confirm the agreed scope and Fees in writing as soon as reasonably possible afterwards.
5. Website Use and Acceptable Use
5.1 Permitted use. You may use the Website for lawful purposes, including to browse and view content, request a quotation or consultation, and share links to the Website.
5.2 Prohibited use. You must not: use the Website in any way that breaches applicable law or regulation; attempt to gain unauthorised access to the Website or its underlying systems; introduce viruses, malware, or other harmful code; scrape, crawl, or use automated means to access content without our permission; use the Website to transmit spam or unsolicited communications; impersonate any person or entity, including when submitting an enquiry; or interfere with the proper functioning of the Website.
5.3 We may suspend or restrict your access to the Website if we reasonably believe you have breached this clause 5.
6. Intellectual Property
All content on the Website, including text, images, graphics, logos, and the case studies and testimonials referred to in clause 18, is owned by us or used with permission and is protected by copyright, database rights, and other intellectual property laws. Except as necessary to make personal use of the Website in accordance with clause 5.1, you may not reproduce, distribute, republish, or use any content from the Website for commercial purposes without our prior written consent.
7. No Guarantee Against Loss, Trespass, Theft or Damage
This clause is important. Please read it carefully.
Security services, including CCTV, alarms, access control, guarding, and property guardians, reduce risk and act as a deterrent. They cannot and do not eliminate the risk of break-in, trespass, squatting, theft, vandalism, arson, or other loss or damage to the Site, however installed, monitored, or staffed. No system or person can guarantee that a property will not be broken into, occupied, or damaged, and we do not make that guarantee.
We will perform the Services with reasonable care and skill, using appropriately trained and, where applicable, licensed Personnel, and we will act on genuine alerts and instructions in accordance with the response arrangements agreed with you. Subject to clause 25 (Limitation of Liability), we are not liable for any loss, theft, trespass, squatting, vandalism, arson, or damage to the Site or its contents that occurs despite our performance of the Services, except to the extent that loss or damage is directly caused by our proven negligence, wilful default, or failure to perform the Services with reasonable care and skill.
Where our website, marketing materials, or sales communications use language such as "guaranteed response" in a general or promotional sense, that language describes our operational target and does not amend, override, or create a contractual guarantee inconsistent with this clause. The Contract, including these Terms, is the entire agreement between the parties in relation to the Services (see clause 30.5).
8. Site Access, Keys and Key Holding
You must provide us and our Personnel with safe and lawful access to the Site to install, maintain, service, and remove Equipment, and to carry out guarding, patrol, key holding, guardian management, or drone survey services as agreed. You are responsible for ensuring the Site is accessible at the times we reasonably require and for obtaining any consents needed for us to access or carry out works at the Site, including from any landlord, freeholder, tenant, or third-party occupier. Delays in providing access, or in providing accurate information about the Site, may affect our ability to meet any indicative timescale referred to in clause 3, and we are not responsible for delay to the extent it is caused by you.
Where you ask us to hold keys or access credentials to the Site, we will store them securely and maintain a record of when they are issued, used, and returned. We will use keys only for the purposes of providing the Services, including attending alarm activations and carrying out patrols or inspections. If keys or credentials are lost or stolen while in our custody as a result of our negligence, we will act promptly to help you re-secure the Site, and clause 25 (Limitation of Liability) governs our liability for any resulting loss.
You must tell us about any known hazards, restricted areas, alarm codes, or site-specific risks before we attend, and keep that information up to date.
9. CCTV, Remote Monitoring and Data Protection
Where we install or operate CCTV or other surveillance equipment at the Site, personal data (including images of individuals) will be processed as part of the Services. The parties' positions under UK GDPR and the Data Protection Act 2018 are as follows, unless we agree otherwise in writing:
- As the owner or occupier of the Site who determines that surveillance should take place at that particular property and for what general purpose (security of the Site), you are ordinarily the data controller for footage captured at your Site, and we act as your data processor in installing, hosting, and operating that equipment on your behalf.
- Where we operate a centralised monitoring or alarm receiving service across multiple sites and independently make operational decisions about escalation, verification, or dispatch of a response, we may act as an independent controller or joint controller in respect of that specific monitoring activity, to the extent required by data protection law.
- We will process footage only for the purposes of providing the Services, in accordance with the Information Commissioner's Office's guidance on the use of surveillance cameras, and will assist you, as controller, in responding to data subject access requests and other rights requests relating to footage we hold, so far as reasonably possible.
- You are responsible, as the occupier of the Site, for ensuring appropriate CCTV signage is displayed to notify individuals that the Site is monitored, and for any wider notification obligations arising from your use of the Site. We can advise on and supply standard signage as part of an installation, but the ongoing legal responsibility for signage at the Site rests with you.
- Footage is retained for the period set out in your service specification, which is typically around 30 days unless a different period is agreed, after which it is routinely overwritten. We will preserve specific footage beyond that period where reasonably requested by you, the police, or another authority in connection with an investigation.
- Requests for footage from third parties, including the police, will ordinarily be referred to you as controller unless you have authorised us to respond directly or we are legally required to disclose the footage, for example under a court order or statutory information request.
This clause governs data generated by security equipment installed at your Site. It is separate from our Privacy Policy, which governs personal data submitted to us directly, such as through our website contact forms — see clause 29.
10. Alarm Response, False Alarms and Response Limitations
Where we provide monitored alarm services, alarm signals are routed to a third-party alarm receiving centre, which will attempt to verify the alert and follow the escalation procedure agreed with you. This may include contacting you or a nominated keyholder, dispatching Personnel, and/or notifying the police. Any response time referred to in our marketing, service pages, or general communications (including average or typical figures) is a target based on normal operating conditions and is not a guaranteed or contractual response time unless specifically agreed in writing for your Site.
Police attendance at alarm activations is provided entirely at the discretion of the relevant police force and in accordance with that force's own policies, over which we have no control. As is standard across the UK private security industry, police forces may reduce, delay, or withdraw their response to a Site following repeated false alarm activations. We will use reasonable efforts to minimise false activations and to keep you informed, but we are not liable for a police force's decision to delay, downgrade, or withdraw attendance.
You are responsible for ensuring that anyone with authorised access to the Site is briefed on how to operate the alarm system correctly to avoid false activations, and we may pass on any reasonable third-party charges, for example excessive call-out charges, that arise from repeated false activations not caused by a fault in our Equipment or our Personnel's error.
11. Property Guardians
Where you instruct us to place property guardians at the Site, please note the following, which is central to how the guardian arrangement works:
- Each Guardian occupies the Site under a Guardian Licence — a licence to occupy, not a tenancy — granted directly between the Guardian and us. You are not a party to the Guardian Licence and do not become the Guardian's landlord or licensor; you have no direct contractual relationship with the Guardian.
- Your contract with us for guardian services is a separate services agreement, under which we agree to select, vet (including DBS checks, referencing, and interview, as described on our website), place, manage, and, on request or termination, remove Guardians from the Site.
- Because Guardians occupy under licence rather than tenancy, we can generally arrange for a Site to be vacated more quickly than would be possible under a residential tenancy, but this is subject to the notice periods in the Guardian Licence and, in some circumstances, to the Guardian's own statutory or common law protections, which we cannot exclude by contract.
- You remain responsible, as owner or occupier of the Site, for ensuring the property is lawfully capable of being occupied under a guardian licence and meets basic health, safety, and habitability standards (see clause 12). We will advise you where we consider works are needed before guardians can be placed.
- We do not guarantee that guardian occupation will prevent squatting, trespass, or damage (see clause 7).
12. Client Warranties About the Property
By instructing us to provide Services, you confirm that:
- you own the Site, or you are authorised by the owner (for example, as a managing agent, tenant, or local authority) to instruct us and to grant the access and permissions needed for us to provide the Services;
- you have disclosed to us, to the best of your knowledge, any known hazards at the Site that could affect our Personnel, Guardians, or Equipment, including but not limited to asbestos, structural instability, unsafe flooring or roofing, hazardous materials, unsecured excavations, or dangerous machinery;
- the Site is, so far as you are aware, reasonably safe for the purpose of the Services you have instructed (including, where relevant, guardian occupation), and you will notify us promptly if that changes; and
- you will comply with any reasonable safety instructions we give in relation to the Site.
We may decline to provide, suspend, or vary the Services, or ask you to remedy a hazard before we or any Guardian attend or occupy the Site, if we reasonably consider the Site to be unsafe.
13. Not Legal, Insurance or Financial Advice
Our website, including our blog and our free tools (such as our squatter eviction timeline estimator and vacant property insurance checker), provides general information about property security, the law relating to squatting, and vacant property insurance. This content is provided for general guidance only. It is not legal advice, insurance advice, or financial advice, does not take account of your specific circumstances, and must not be relied on as a substitute for advice from a qualified solicitor, insurance broker, or other appropriate professional. Beyond Property is not a law firm and is not an insurance provider or broker. Nothing on our website or in these Terms creates a solicitor-client or adviser-client relationship between us and you.
Where our Personnel give practical suggestions in the course of providing the Services (for example, recommending additional security measures), those suggestions are operational recommendations, not legal or insurance advice, and you remain responsible for taking your own professional advice where needed.
14. Your Insurance Obligations
You are responsible for arranging and maintaining adequate buildings, contents, public liability, and any other insurance appropriate to the Site, and for notifying your own insurer that the Site is, or will become, vacant, occupied by guardians, or otherwise in a state relevant to your policy. Most standard insurance policies restrict or exclude cover once a property has been unoccupied for a set period (commonly around 30 to 60 days), and insurers commonly impose conditions such as regular inspections, secured entry points, or monitored alarms as a condition of continued cover.
We are not responsible for the terms of your insurance policy, for confirming your cover status, or for any gap in your insurance cover, whether or not you have taken out the Services described in this Contract. Any statement that a particular Service (for example, guardian occupation) "may" help maintain insurance cover is general commentary only; you should always obtain written confirmation from your own insurer before relying on any security measure for insurance purposes.
15. Equipment: Title, Risk and Recovery
Unless we have agreed in writing that you are purchasing Equipment outright, all Equipment installed or placed at the Site by us remains our property at all times, whether or not it is fixed to the Site, and you acquire no title or ownership interest in it. You must not sell, remove, relocate, tamper with, or grant any third party rights over the Equipment.
You are responsible for taking reasonable care of the Equipment while it is at the Site and for its safekeeping, and for notifying us promptly of any damage, fault, or interference. We remain responsible for maintaining and repairing Equipment as part of the Services, other than damage caused by your act, omission, or negligence, or by a third party at or in connection with the Site, which we may charge you to repair or replace at our reasonable cost.
On termination or expiry of the Contract, we are entitled to attend the Site within a reasonable period to recover our Equipment. You must provide reasonable access for this purpose. If you unreasonably prevent us from recovering Equipment, we may charge you its replacement value and any reasonable costs of attempting recovery.
16. Personnel, Subcontractors and Vetting
Personnel deployed to provide the Services may be employed directly by us or engaged through vetted subcontractors. In either case, we require that: security officers hold a valid Security Industry Authority (SIA) licence appropriate to their role; guardians and, where applicable, other Personnel undergo a Disclosure and Barring Service (DBS) check, reference checks, and identity and right-to-work verification, consistent with the vetting standards described on our website; and drone pilots hold the qualifications required for commercial drone operations under Civil Aviation Authority (CAA) rules.
We remain responsible for the acts and omissions of any subcontractor engaged to perform the Services as if they were our own, to the same extent as set out in these Terms.
17. Health and Safety and Lone Working
We operate our own health and safety and lone working policies for our Personnel and Guardians, including for Personnel attending Sites alone or outside normal hours, for example key holder call-outs. You must ensure the Site does not present an unreasonable risk to our Personnel or Guardians and must comply with any applicable statutory duties as owner, occupier, or principal contractor of the Site, including, where relevant, obligations under the Health and Safety at Work etc. Act 1974 and, on construction sites, the Construction (Design and Management) Regulations. You must provide us with any site-specific risk assessment or method statement information reasonably requested before work begins.
18. Case Studies and Testimonials
The Website may display case studies, testimonials, or descriptions of past work, which may reference client sectors, property types, or (with permission) third-party branding. These are provided for illustrative purposes only, represent our understanding of the work carried out, and do not imply that any future engagement will achieve the same results, since every Site and situation is different.
19. External Links
The Website may contain links to third-party websites, including technology partners and suppliers. We are not responsible for the content, accuracy, privacy practices, or products or services of linked sites, and access to external links is at your own risk.
20. Fees, Invoicing and Payment
Fees for the Services are as set out in our quotation, proposal, order confirmation, or invoice. We are not currently registered for VAT, and no VAT is charged on our Fees. If we become VAT registered in the future, VAT will be added to Fees at the applicable rate from the date our registration takes effect, and this will be shown separately on our invoices.
We invoice electronically, and payment can be made by the methods stated on the invoice, including by card or bank transfer through our invoicing provider. We invoice in accordance with the frequency agreed with you, for example monthly in advance for ongoing monitoring, guarding, or guardian management Services, or on completion for one-off Services such as a drone survey. Payment is due within 30 days of the invoice date, unless a different payment period is stated on the invoice or agreed with you in writing.
Some Services, particularly installation or one-off Services, may require a deposit or payment in advance before work begins, as set out in your quotation or order confirmation.
21. Late Payment
Where the Client is a business, that is, not a Consumer, if you do not pay an invoice by its due date, we may charge statutory interest and compensation on the overdue amount in accordance with the Late Payment of Commercial Debts (Interest) Act 1998, currently calculated at the Bank of England base rate plus 8% per year, together with the fixed statutory compensation sums provided for under that Act, without prejudice to any other right or remedy available to us, including suspension of the Services under clause 22.
Where the Client is a Consumer, we may charge interest on overdue amounts at a reasonable rate reflecting our costs of late payment, and will set this out clearly in your service agreement; nothing in this clause affects your statutory rights.
22. Term, Suspension and Termination
The Contract begins on the date it is accepted and continues for any minimum term agreed in your quotation or service agreement, and afterwards on a rolling basis subject to any notice period stated in that agreement. We do not generally require long-term contracts or minimum sign-up periods for our standard Services; the specific term and notice period applicable to your Services will be confirmed in your service agreement or order confirmation.
We may suspend the Services (including monitoring, patrols, key holding, or guardian management) immediately, on notice where reasonably practicable, if: you fail to pay any Fees when due and do not remedy this within 7 days of a reminder; you are in material breach of these Terms, including the warranties in clause 12; or we reasonably consider the Site to be unsafe for our Personnel or Guardians.
Either party may terminate the Contract for the other party's uncured material breach, or if the other party becomes insolvent, on written notice. We may also terminate immediately if you fail to provide safe or lawful access to the Site for an extended period, or if continuing to provide the Services would put our Personnel or Guardians at risk or would require us to act unlawfully.
23. Consequences of Termination
On termination or expiry of the Contract: you must pay all Fees accrued up to the date of termination; we will arrange a final site visit, within a reasonable period, to recover our Equipment as described in clause 15; and, where guardians are in place, we will manage the process of vacating guardians from the Site in accordance with the applicable Guardian Licence notice periods, which is not instantaneous and may take a number of weeks. Termination does not affect any rights or liabilities that have accrued before the date of termination.
24. Insurance
We maintain public liability insurance and professional indemnity insurance in connection with the Services, at levels of cover we consider appropriate to the scale and nature of the Services we provide. Details of our current cover, including the applicable limits, are available on request by contacting us using the details in clause 32.
25. Limitation of Liability
25.1 What we do not exclude. Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability which cannot lawfully be excluded or limited, including, where the Client is a Consumer, rights that cannot be excluded under the Consumer Rights Act 2015.
25.2 Consumer Clients. Where the Client is a Consumer, we will perform the Services with reasonable care and skill as required by the Consumer Rights Act 2015, and nothing in these Terms limits any right the Consumer has to require us to repeat a service that has not been performed with reasonable care and skill, to a price reduction, or to any other remedy available under that Act.
25.3 Business Clients. Where the Client is not a Consumer, subject to clause 25.1: (a) we are not liable for any indirect or consequential loss, loss of profit, loss of business, loss of anticipated savings, or loss of data, in each case however arising; (b) subject to clause 7 (No Guarantee) and clause 25.3(a), our total aggregate liability arising out of or in connection with the Contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the greater of (i) the total Fees paid by the Client under the Contract in the 12 months preceding the event giving rise to the claim, and (ii) the limit of our public liability insurance cover in force at the relevant time, details of which are available on request under clause 24.
25.4 Third-party criminal acts. Reflecting clause 7, we are not liable for any loss or damage caused by the criminal or wrongful acts of a third party, including theft, burglary, criminal damage, arson, or squatting, except to the extent that such loss or damage was directly caused by our failure to perform the Services with reasonable care and skill.
26. Indemnity
You agree to indemnify us against reasonable claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms, your provision of inaccurate information about the Site, or your infringement of any third-party rights, except to the extent caused by our negligence or breach of the Contract.
27. Your Right to Cancel (Consumer Clients Only)
If you are a Consumer and you enter into the Contract with us at a distance, for example by phone or through our website, or away from our business premises, you may have a right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Where this right applies, you can cancel within 14 days of the day the Contract is entered into, without giving a reason, by telling us in writing, including by email to [email protected].
If you ask us to begin providing the Services during this 14-day cancellation period, you must make an express request for us to do so, for example in writing or by clear affirmative confirmation. If you then cancel after work has started, you will be required to pay for the Services provided up to the point you told us you were cancelling, calculated in proportion to the full price of the Contract. If we have fully performed the Services within the 14-day period at your express request, you lose your right to cancel once performance is complete.
This clause does not apply to business Clients, who do not have a statutory cancellation right under the 2013 Regulations; any right for a business Client to cancel is as set out in the relevant service agreement.
28. Complaints
If you are unhappy with any aspect of the Services, please contact us at [email protected] or 020 3355 0068, and where possible put your complaint in writing so we can investigate it properly. We aim to acknowledge complaints promptly and to work with you to resolve the issue.
If, having exhausted our complaints process, you remain unhappy and you are a Consumer, you may be entitled to refer the matter to an alternative dispute resolution provider, or to seek guidance from Citizens Advice or Trading Standards. In either case, you may also bring a claim through the courts of England and Wales.
29. Website Privacy, Data Protection and Cookies
Our collection and use of personal data submitted to us directly through the Website, for example through our contact form, is governed by our Privacy Policy, which explains how we collect, use, and protect that information in accordance with UK GDPR and the Data Protection Act 2018. It does not apply to CCTV footage or other data generated by security equipment installed at a Site, which is governed by clause 9.
Your use of the Website is also subject to our Cookie Policy. We only use cookies that are strictly necessary for the Website to function, as explained in that policy.
30. General
30.1 Force majeure. Neither party is liable for any failure or delay in performing its obligations under the Contract to the extent caused by events outside its reasonable control, including severe weather, fire, flood, power or telecommunications network failure, industrial action, or acts of government.
30.2 Notices. Notices under these Terms should be sent to the contact details in clause 1, or to the postal or email address you have provided to us.
30.3 Assignment. You may not assign, transfer, or subcontract your rights or obligations under the Contract without our prior written consent. We may assign or transfer the Contract to another company within our group, or to a purchaser of our business or the relevant part of it, provided this does not materially affect the level of service you receive.
30.4 Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
30.5 Entire agreement. These Terms, together with any quotation, order confirmation, or service agreement we provide to you, constitute the entire agreement between us in relation to the Services, and supersede all prior discussions, representations, or agreements, except that nothing in this clause excludes liability for fraudulent misrepresentation.
30.6 Changes to these Terms. We may update these Terms from time to time, for example to reflect changes in the law or in how we operate. Changes to the website use terms in clause 5 take effect when posted. We will give you reasonable notice of any material change that affects an ongoing Contract, and continued use of the Services after that notice period constitutes acceptance of the updated Terms, save that any change will not apply retrospectively to reduce your accrued rights.
30.7 Third-party rights. Save for any subcontractor or group company entitled to rely on a specific clause where stated, a person who is not a party to the Contract has no right to enforce any of its terms under the Contracts (Rights of Third Parties) Act 1999.
31. Governing Law and Jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or the Services (including non-contractual disputes or claims), are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim, save that if you are a Consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
